01 Scope of these Terms

These Terms govern access to and use of thx.marketing, operated by thx.marketing Piotr Burnat (“THX”, “we”, “us”).

The website presents THX, our approach and examples of interactive buying experiences. These Terms govern use of the website itself. They do not replace the separate proposal, statement of work, order, contract or other agreement that applies if you engage THX to provide services.

02 Website information

We aim to keep website information useful and reasonably current, but content is provided for general information and marketing purposes. It may be changed, corrected, expanded or removed without prior notice.

Nothing on the website constitutes a binding commercial offer unless we expressly state otherwise. A project, price, scope, delivery date or commercial commitment becomes binding only when agreed through the applicable contractual process.

03 Interactive demos, calculators and assessments

The website may include calculators, comparisons, assessments, configurators, business-case examples or other interactive experiences. Unless a specific tool expressly says otherwise, website demos use simplified or illustrative assumptions and are intended to demonstrate the type of experience THX can build.

Outputs are not guarantees, quotations, financial advice, investment advice, legal advice, accounting advice or professional recommendations. They should not be treated as a substitute for information verified for your specific organisation, product, contract or decision.

We may restrict access where reasonably necessary to protect the website, users, our systems or our legal rights.

Unless stated otherwise, the website’s design, copy, visual system, code, graphics, concepts, layouts and other original materials are owned by or licensed to THX and are protected by applicable intellectual-property laws.

You may view and use the website for ordinary internal or business-evaluation purposes. No ownership rights are transferred to you. Brand names, logos or materials belonging to third parties remain the property of their respective owners.

These Terms do not prevent any use that applicable law expressly permits without our consent.

06 Information you send to us

If you submit a contact form, email, brief, website URL or other information, you confirm that you are entitled to provide it for the purpose of the enquiry.

You do not transfer ownership of your materials merely by sending them to us. You allow us to review and use the submitted material only to the extent reasonably necessary to respond to your enquiry, evaluate a potential project, protect our systems or comply with law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by mandatory law, including liability that cannot legally be excluded for intentional misconduct or other legally non-excludable matters.

Any liability relating to paid THX services is governed primarily by the contract applicable to those services rather than these website Terms.

Our Privacy Policy explains how personal data is processed. Our Cookie Policy explains how cookies and similar technologies are used and how optional consent choices can be managed.

11 Governing law and disputes

These website Terms are governed by Polish law, without prejudice to any mandatory rules that apply regardless of a contractual choice of law.

Where a dispute relating solely to use of this website cannot be resolved informally, jurisdiction is determined under the rules applicable to the parties and the dispute. Nothing in this section removes rights or jurisdiction protections that cannot legally be waived.

We may update these Terms to reflect changes to the website, our operating model or applicable law. The date at the top of the page identifies the current version.
